It has happened before but it's quite uncommon. It's basically saying that there wasn't enough evidence to go forward in this case and obviously the prosecution was wrong and the jury was wrong. This should not have led to a conviction.

He's one of the most respectful, kind, nice, decent people I know.

Before we execute Mister Rutherford, shouldn't we resolve that?

Right now, I would think this is a pretty strong signal that executions in Florida may not occur until the Hill case is decided. However, there are no guarantees.

It's not that you can not ever do lethal injection, it's that with the three drugs they chose the state is being deliberately indifferent to the infliction of pain.

I certainly think it helps and probably means that Mr. Rutherford won't be executed Tuesday. Before we can go to federal court we really need to exhaust our state-court remedies.
