If we assume the higher sum of money here, it would put MP3.com out of business. It's very unlikely that they would receive financing to pay these damages.

They have nothing to celebrate. Revenues were just 'blah' all around. Very mediocre in all segments.

Expectations are very high for both companies and it does worry me. After having relatively good quarters, the companies will probably want to be conservative.
