Microsoft did a whole bunch more things wrong after the consent decree. A breakup is not as preposterous today as it was back then.

He will be one influential judge--no question about it. I think the justices will look to him for guidance because he had that job.

It's not without basis to say that the Court of Appeals is the preferred place for Microsoft, ... But normally on fact finding, appeals judges give great deference to a lower court.

Perhaps the EC is going to investigate it. Maybe they fear that a combination of content companies with distribution companies is a problem, but I am wrestling with seeing what the antitrust problem is in the U.S.
