There is no such thing as a draft exception.

He has an inherent right to review that document.

He has an absolute right to his own copy of that report. That is not a qualified right with going into a room and with people looking over your shoulder.

We believe important principles are at stake. A judge can't tell a newspaper what it can or can't publish and a judge cannot restrict legitimate news gathering activities.

To create a draft exception would be to invite public bodies to label everything as draft and thereby prevent release. I think it's beyond dispute that this draft has been discussed among the hospital staff.

What they've done is unconstitutional.
